Pogoji poslovanja

Splošni pogoji spletne trgovine so sestavljeni v skladu z Zakonom o varstvu potrošnikov (ZVPot), Zakonom o varstvu osebnih podatkov (ZVOP-1) ter Zakonom o elektronskih komunikacijah (ZEKom-1).

S spletno trgovino upravlja podjetje An-Ja kozmetične storitve Anja Lugariček s.p., Podgorje 7, 3000 Celje, DŠ: SI24073563, ki je tudi prodajalec.

Splošni pogoji poslovanja opredeljujejo delovanje spletne trgovine, pravice in obveznosti uporabnika in trgovine ter urejajo poslovni odnos med prodajalcem in kupcem.

Kupca zavezujejo splošni pogoji, ki so veljavni v trenutku nakupa (oddaje spletnega naročila). Kupec je ob oddaji naročila vsakič posebej opozorjen na splošne pogoje poslovanja in z oddajo naročila potrdi svojo seznanjenost z njimi.

Opredelitev pojmov

Ponudnik je An-Ja kozmetične storitve Anja Lugariček s.p., Podgorje 7, 3000 Celje, DŠ: SI24073563 Uporabnik je oseba, ki uporablja naš sistem, torej kupec v spletni trgovini

Spletna prodajalna je informacijski sistem namenjen predstavitvi in prodaji izdelkov uporabniku.

Splošni pogoji poslovanja obravnavajo delovanje spletne prodajalne lepika.si (kozmetična spletna trgovina), pravice uporabnika ter poslovni odnos med ponudnikom in kupcem.

Ponudnik se zavezuje, da bo kupcu vselej zagotovil naslednje informacije:

  • identiteto podjetja (ime in sedež podjetja, številka registra)

  • kontaktne naslove, ki omogočajo hitro in učinkovito komunikacijo (e-pošta, telefon)

  • bistvene značilnosti blaga oziroma storitev (vključno s poprodajnimi storitvami in garancijami)

  • dobavljivost izdelkov (vsak izdelek ali storitev, ki je v ponudbi na spletni strani, naj bi bil dobavljiv v razumljivem roku)

  • pogoje dostave izdelka ali izvršitve storitve (način, kraj in rok dostave)

  • vse cene morajo biti jasno in nedvoumno določene, razvidno mora biti ali že vsebujejo davke in stroške prevoza

  • način plačila in dostave

  • časovno veljavnost ponudbe

  • rok, v katerem je še možno odstopiti od pogodbe ; poleg tega tudi o tem, če in koliko stane kupca vračilo izdelka

  • pojasnjen mora biti postopek ob pritožbi, vključno z vsemi podatki o kontaktni osebi ali službi za stike s kupci

Postopek nakupa

Po ogledu izdelkov na spletni strani, želen izdelek z označbo o barvi in/ali velikosti in količini želenih izdelkov odda v košarico. V nadaljnjih korakih mora označiti še kraj dostave in način plačila. Ko uporabnik izbere izdelek ali izdelke in s potrdilom na gumb ZAKLJUČI NAKUP odda naročilo, mu spletna prodajalna samodejno “generira – ustvari” in pošlje elektronsko pošto s podrobnostmi naročila (izdelki, cene, količine, uporabnikovi podatki …). S tem je naročilo potrjeno, izdelki bodo poslani v najkrajšem možnem roku. Če je rok dobave več kot 2 delovna dni ponudnik o tem obvesti kupca.

Akcijska cena izdelka

Določeni izdelki, ki so dlje časa v redni prodaji, se v določenem obdobju potrošnikom ponudijo po akcijskih znižanih cenah. Akcijske cene veljajo v navedenem obdobju.

VRAČILO BLAGA IN PRAVICA DO ODSTOPA OD POGODBE ZA FIZIČNE OSEBE

Kupec (navedeno velja izključno za fizične osebe, ki pridobijo blago za namene izven svoje pridobitne dejavnosti) ima v skladu z Zakonom o varstvu potrošnikov pravico, da v 14 dneh od prevzema blaga podjetju sporoči na e-mail info@lepika.si ali po telefonu na 070 873 227, da odstopa od pogodbe, ne da bi mu bilo treba navesti razlog za svojo odločitev. Rok se začne šteti en dan po datumu prevzema blaga.

Strošek, ki bremeni kupca v zvezi z odstopom od pogodbe je strošek vračila blaga, razen v primeru, ko je prodajalec kupcu omogočil tudi brezplačno šolanje za uporabo blaga. V tem primeru se, ob odstopu od pogodbe, kupcu zaračuna stroške šolanja za uporabo blaga, v višini, ki je navedena v ponudbi in je kupcu znana vnaprej.

Blago je potrebno vrniti ponudniku najkasneje v roku 14 dni od oddanega sporočila o nameravanem vračilu. Vrnitev prejetega blaga podjetju v roku za odstop od pogodbe se šteje za sporočilo o odstopu od pogodbe.

Izdelek, ki ga kupec vrača, mora biti nerabljen, nepoškodovan, v originalni embalaži in v nespremenjeni količini. V kolikor je blago poškodovano, umazano, brez originalne embalaže ali so vidni sledovi uporabe (v notranjosti ali zunanjosti artikla), si prodajalec pridržuje pravico do znižanja kupnine.

Kupec nima pravice do odstopa od pogodbe, pri pogodbah katerih predmet je blago, ki je bilo izdelano po natančnih navodilih kupca, ki je bilo prilagojeno njegovim osebnim potrebam, ki zaradi svoje narave ni primerno za vračilo, ki je hitro pokvarljivo ali kateremu je že potekel rok uporabe.

Kupec mora artikel vrniti prodajalcu nepoškodovan in v nespremenjeni količini, razen če je artikel uničen, pokvarjen, izgubljen ali se je njegova količina zmanjšala, ne da bi bil za to kriv kupec. Kupec artiklov ne sme neovirano uporabljati do odstopa od pogodbe. Kupec sme opraviti ogled in preizkus artiklov v obsegu, kot je to nujno potrebno za ugotovitev dejanskega stanja. Kupec odgovarja za zmanjšanje vrednosti blaga, če zmanjšanje posledica ravnanja, ki ni nujno potrebno za ugotovitev narave, lastnosti in delovanja blaga.

Posebna določila

V kolikor kupec ob nakupu blaga prejme tudi brezplačno šolanje za uporabo blaga in kasneje v zakonskem roku odstopi od pogodbe, je dolžan povrniti stroške brezplačnega šolanja, izvedenega s strani prodajalca.

V primeru nakupa večje količine blaga se kupcu, skladno z internimi ceniki podjetja, obračuna količinski popust, ki je vezan na znesek nakupa. V kolikor stranka delno odstopi od pogodbe, se ji končni količinski popust zmanjša v sorazmernem delu.

Plačilo

Ponudnik izda račun na trajnem mediju, z razčlenjenimi stroški in obvestilom uporabniku, kako odstopiti od nakupa in kako izdelke vrniti. Uporabnik plača naročeno blago po predračunu na TRR ali plačilni kartici.

Dobavni rok

Za izdelke na zalogi je dobava blaga 2-4 delovnih dni v ostalih primerih pa do 15 dni. Za izdelke, ki jih nimamo na zalogi je dobavni rok do 15 dni po prejetem naročilu. V primeru daljšega dobavnega roka vas bomo o dobavnem roku obvestili po elektronski pošti ali pa po telefonu. Prav tako vas bomo obvestili v primeru nedobavljivosti izdelka.

Dostava

Ponudnik mora blago oziroma storitev dostaviti v obljubljenem času. Ob dobavi mora uporabniku nuditi še dodatne informacije glede pravice do odstopa, predvsem pogoje in način izvršitve same pravice. Zagotoviti mora vse potrebne informacije glede naslova, kamor se uporabnik lahko obrne v primeru pritožbe in informacije glede garancij ter servisa oziroma drugih storitev po zaključku pogodbe. Stroški dostave so odvisni od naročila, strošek je odvisen od teže naročenih izdelkov.

Pri vnosu je kupec predhodno dolžan zagotoviti neovirano pot za vnos naročenega blaga v stanovanje ter poskrbeti za zaščito tal in ostale opreme v stanovanju. V kolikor je pot v stanovanje ovirana ali karakteristike objekta tega ne dovoljujejo (ozko stopnišče, krožne stopnice), vam vnosa ne moremo zagotoviti. Pri tem mora biti širina vrat na objektu vsaj 80 cm.

V primeru, da vztrajate z vnosom v prostor in ne izpolnjujete opisanih pogojev se lahko zgodi materialna škoda bodisi na izdelku, ki ste ga kupili ali na vaši nepremičnini. Mi ne odgovarjamo za puščene posledice.

Pri prevzemu aparata ga je stranka dolžna zavarovati. V primeru, da ga prevzamemo brez zaščite za nastalo škodo (risi, udarnine, itd.), ki se je zgodila med transportom ne odgovarjamo.

Poštnina

Dostava naročenih izdelkov v delovnem tednu od ponedeljka do petka je takšna kot je razvidno ob izdelku.

Poštnino za dostavo naročenega blaga plača kupec.

Cenik pošiljanja:

do 25kg: 4,99€
26- 40kg: 24,99€
nad 41kg: 60,00€
V primeru plačila po povzetju je doplačilo 1,00€.

Reklamacije ob prevzemu pošiljke

Če prejmete napačno število izdelkov, ki ne ustreza količini na prevzemnih dokumentih, ali je prišlo do poškodbe blaga med prevozom, se obrnite na dostavno službo, ki je opravila dostavo. Obenem obvestite tudi nas, da vam pomagamo pri rešitvi težave.

Če ob prevzemu opazite, da je artikel ali pošiljka fizično poškodovana, da manjka del vsebine ali kaže znake odpiranja, lahko pri dostavljalcu sprožite postopek odškodnine.

Če vam je paket dostavil GLS in ste ugotovili, da je artikel poškodovan, da manjka vsebina ali da je bil paket odprt, morate škodo prijaviti v roku 7 dni od prejema paketa na e-naslov info@lepika.si ali po telefonu 070 873 227. Pri prijavi škode potrebujemo fotografije paketa, embalaže, poškodovanega artikla, GLS nalepke in opis poškodbe. Po dogovoru z referentom lahko organiziramo prevzem poškodovanega paketa na vašem naslovu.


Odstop od pogodbe (za potrošnike)

Fizične osebe imajo po Zakonu o varstvu potrošnikov pravico, da v 14 dneh po prejemu izdelka prodajalcu sporočijo, da odstopajo od pogodbe, brez obveznosti navedbe razloga. V tem primeru mora potrošnik blago na lastne stroške vrniti na naš naslov najkasneje v 14 dneh od sporočila o odstopu. Rok začne teči en dan po prevzemu pošiljke. Edini strošek potrošnika je strošek vračila blaga (po ceniku dostavne službe).

Vračilu obvezno priložite kopijo računa in pravilno izpolnjen obrazec za vračilo, da zagotovimo hitrejšo obdelavo.

Pomembno:

  • Ogled in preizkus izdelka je dovoljen le v obsegu, ki je potreben za ugotovitev dejanskega stanja. Vsaka uporaba blaga, ki presega ta obseg, se šteje kot uporaba, pri čemer odgovarjate za zmanjšano vrednost izdelka.

  • Če ugotovite, da artikel ne ustreza (barva, velikost ipd.), ga ne odpirajte v celoti. Etikete in oznake morajo ostati nedotaknjene.

  • Embalažo in dodatke skrbno shranite vsaj pol leta po prevzemu.

  • Izdelek mora biti vrnjen nepoškodovan in v nespremenjeni količini, razen če je bil uničen ali poškodovan brez vaše krivde.

Pri pošiljanju izdelka na naš naslov ne sprejemamo pošiljk z odkupnino.

Pravice do vračila kupnine, garancije, uveljavljanja stvarnih napak in reklamacij ureja Zakon o varstvu potrošnikov (ZVPot).


Napotki za odstop od pogodbe

Pri spletnem nakupu si izdelkov ne morete fizično ogledati, zato vam omogočamo možnost odstopa od pogodbe v zakonskem roku. Za brezhiben postopek upoštevajte:

  • Embalažo odpirajte previdno in jo hranite nedotaknjeno, dokler niste prepričani o ustreznosti izdelka.

  • Pri rokovanju lahko pride do poškodb, zlasti pri lakiranih površinah (monitorji, LCD televizorji ipd.).

  • Pazljivo odstranjujte zaščitne folije.

  • Pred vgradnjo aparatov se prepričajte o ustreznosti.

Možnost odstopa od pogodbe ni namenjena uveljavljanju garancije ali stvarne napake, temveč za primere, ko izdelek ne ustreza vašim pričakovanjem.


Vračilo artiklov

Napotki:

  • Priporočamo uporabo dostavne službe s sledenjem.

  • Stroške pošiljanja krije pošiljatelj, razen če ni dogovorjeno drugače. Pošiljk z odkupnino ne sprejemamo.

  • Če uveljavljate garancijo, boste popravljen artikel prejeli nazaj po pošti.


Vračilo artiklov za pravne osebe

Pravne osebe (podjetja, s.p. ipd.) nimajo pravice do odstopa od pogodbe v 14 dneh, kot velja za fizične osebe. Vračilo je možno le v okviru garancijskih pogojev. Za dodatne informacije nas kontaktirajte na 070 873 227 ali info@lepika.si.


Vračilo artiklov z našim prevzemom

Če organiziramo prevzem z našo dostavno službo, ne odgovarjamo za morebitne poškodbe paketov.


Napotki za vračilo artiklov:

  • Priložite obrazec za odstop od pogodbe.

  • Pošljite artikle na naslov: Podgorje 7, 3000 Celje.

  • Izdelke pripravite za varen transport (po možnosti v originalni embalaži).

  • Pošiljk z odkupnino ne sprejemamo.

  • Če ste ob nakupu uporabili kodo za popust, se ta vrednost ne povrne. Povrnemo le dejansko plačan znesek.

  • Povračilo denarja bo izvedeno v roku 14 dni od prejetja obvestila o odstopu. Denar vrnemo na enak način, kot je bilo izvedeno plačilo, razen če se dogovorimo drugače.

  • Izdelkov, ki so zapečateni in jih ni mogoče vrniti iz higienskih razlogov, po odprtju pečata ni možno vrniti.

V izjemnih primerih, ko izdelki niso vrnjeni skladno z ZVPot, lahko ponudimo odkup z odškodnino po dogovoru.


Reklamacije

Če v paketu manjkajo dokumenti, garancije, kabli, navodila v slovenskem jeziku ali je račun napačen, se obrnite na nas. Manjkajoče dokumente in pojasnila bomo dostavili v najkrajšem možnem času.

Če želite izdelek zamenjati zaradi napake, ga vrnite nerabljenega, nepoškodovanega in v originalni embalaži. Ob vračilu priložite kopijo računa in obrazec za vračilo.

GARANCIJA

Proizvajalec je v skladu z zakonom dolžan kupcu zagotoviti garancijo za brezhibno delovanje kupljenega blaga. Garancijo lahko kupec uveljavlja neposredno pri proizvajalcu ali njegovem pooblaščenem servisu. Garancijo lahko kupec uveljavlja z garancijskim listom in računom prodajalca. Proizvajalec je dolžan garancijsko popravilo opraviti v 45 dneh od prejema blaga, v nasprotnem primeru pa izdelek zamenjati z drugim, enakovrednim in brezhibnim izdelkom.

Kupec lahko garancijo uveljavlja tudi pri prodajalcu, vendar tudi v tem primeru velja določilo iz prejšnjega odstavka. Posredovanje blaga v garancijo se opravi v skladu s pogoji, ki jih proizvajalec navede na garancijskem listu, kupec s tem nima stroškov.

Jamčevalni zahtevki v primeru neskladnosti

Jamčevalni zahtevki in druge pravice potrošnika pri nakupu. V primeru neskladnosti blaga je potrošnik, ki je o neskladnosti blaga obvestil prodajalca, pod pogoji in v vrstnem redu, upravičen da:

  • zahteva od prodajalca brezplačno vzpostavitev skladnosti blaga;

  • zahteva znižanje kupnine v sorazmerju z neskladnostjo ali odstopi od prodajne pogodbe in zahteva vračilo plačanega zneska.

Potrošnik lahko zadrži plačilo preostalega dela kupnine ali dela tega preostalega dela kupnine, dokler prodajalec ne izpolni svoje obveznosti. Potrošnik to pravico uveljavlja z izjavo, s katero prodajalca obvesti o svoji odločitvi.

V vsakem primeru ima potrošnik tudi pravico, da od prodajalca zahteva povrnitev škode, zlasti pa povračilo stroškov materiala, nadomestnih delov, dela, prenosa in prevoza blaga, ki nastanejo zaradi uveljavljanja jamčevalnega zahtevka.


Vzpostavitev skladnosti

Potrošnik lahko od prodajalca zahteva, da v razumnem roku od trenutka, ko prodajalca obvesti o neskladnosti, ki ni daljši od 30 dni, brezplačno vzpostavi skladnost blaga brez znatnih nevšečnosti za potrošnika, pri čemer se upoštevata zlasti narava blaga in namen, za katerega potrošnik blago potrebuje.


Znižanje kupnine in odstop od prodajne pogodbe

Potrošnik lahko zahteva sorazmerno znižanje kupnine ali odstopi od prodajne pogodbe v katerem koli od naslednjih primerov:

  • prodajalec ni popravil ali zamenjal blaga ali, kadar je to ustrezno, ni končal popravila ali izvedel zamenjave blaga v skladu z zakonom oziroma je zavrnil potrošnikov jamčevalni zahtevek za vzpostavitev skladnosti blaga;

  • neskladnost obstaja, čeprav je prodajalec poskušal vzpostaviti skladnost;

  • narava neskladnosti je tako resna, da upravičuje takojšnje sorazmerno znižanje kupnine ali odstop od prodajne pogodbe, ali

  • prodajalec je izjavil ali pa je iz okoliščin očitno, da prodajalec ne bo vzpostavil skladnosti blaga v razumnem roku ali brez znatnih nevšečnosti za potrošnika.

Ne glede na prejšnji odstavek lahko potrošnik odstopi od prodajne pogodbe in zahteva vračilo plačanega zneska, če se neskladnost pojavi v manj kot 30 dneh od dobave blaga.

Če potrošnik zahteva sorazmerno znižanje kupnine, je znižanje kupnine sorazmerno zmanjšanju vrednosti blaga, ki ga je potrošnik prejel, v primerjavi z vrednostjo, ki bi jo imelo blago, če bi bilo skladno.

Odstop od prodajne pogodbe potrošnik uveljavlja z izjavo, s katero prodajalca obvesti o odločitvi, da odstopa od prodajne pogodbe.


Varnost

Ponudnik uporablja ustrezna tehnološka in organizacijska sredstva za zaščito prenosa in shranjevanja osebnih podatkov, naročil ter plačil.


Komunikacija

Z uporabnikom sme ponudnik stopiti v stik preko sredstev komunikacij na daljavo le, če temu prvi izrecno ne nasprotuje.


Arhiviranje pogodb

Pogodba, ki jo skleneta ponudnik in uporabnik je trajno shranjena pri podjetju An-Ja kozmetične storitve Anja Lugariček s.p., Podgorje 7, 3000 Celje, DŠ: SI24073563. Za ogled oziroma ponovni prejem pogodbe, nam pošljite sporočilo s podatki o nakupu na naslov: info@lepika.si ali nas pokličite na telefon 070873227.


Reklamna elektronska sporočila morajo vsebovati naslednje sestavine:

  • jasno in nedvoumno morajo biti označena kot reklamna sporočila

  • pošiljatelj mora biti jasno razviden

  • različne akcije, promocije in druge tržne tehnike, morajo biti označene kot takšne. Prav tako morajo biti jasno določeni udeležbe v njih.

  • željo uporabnika, da ne prejemajo reklamnih sporočil, je potrebno spoštovat


Piškotki

Med brskanjem po spletni trgovini Lepika.si, se skupaj z vsebino datotek na računalnike uporabnikov in registriranih uporabnikov prenašajo tudi kratke tekstovne datoteke – piškotki (cookies). Piškotki vsebujejo podatke, ki so potrebni za pravilno delovanje nekaterih aplikacij v spletni trgovini, hkrati pa uporabnikom omogočajo nekatere prednosti pri uporabi storitev.

Uporabnik ali registriran uporabnik lahko z nastavitvami svojega spletnega brskalnika določi, ali bo dopustil uporabo piškotov na posameznem spletnem mestu ali ne. Uporaba storitev spletne trgovine, za katere se zahteva registracija, brez omogočenih piškotov ni mogoča.

Na spletni strani Lepika.si uporabljamo različne piškotke, da bi vam omogočili nemoteno in prijazno nakupovanje v naši spletni trgovini.

Vrste piškotkov:

  • Piškotki, ki so potrebni za nemoteno delovanje spletnega mesta in brez katerih določeni procesi ne bi delovali pravilno (npr. nakupni proces).

  • Piškotki, ki omogočajo boljšo funkcionalnost, boljše delovanje spletnega mesta in boljšo uporabniško izkušnjo. Zapomnijo si določene vaše nastavitve.

Kako upravljati piškotke?

Vsak uporabnik se lahko odloči ali bo dopustil uporabo piškotkov na posameznem spletnem mestu ali ne. Kar pomeni, da je potrebno tudi na naši spletni strani potrditi, da želite naše piškotke.

Pritožbe

Ponudnik spoštuje veljavno zakonodajo o varstvu potrošnikov. Ponudnik mora postaviti učinkovit sistem obravnavanja pritožb in določiti osebo, s katero se, v primeru težav, kupec lahko poveže telefonsko ali po elektronski pošti. Postopek za oddajo pritožb mora biti na voljo na spletnih straneh, enostaven za uporabo in zaupen. Ponudnik mora v petih delovnih dneh potrditi, da je prejel pritožbo, sporočiti kupcu, kako dolgo jo bo obravnaval in ga vseskozi obveščati o poteku postopka. Ponudnik se zaveda, da je bistvena značilnost potrošniškega spora, vsaj kar zadeva sodno reševanje, njegova nesorazmernost med ekonomsko vrednostjo zahtevka in stroški, ki nastanejo pri reševanju samega spora. To je tudi glavna ovira, da potrošnik ne sproži spora pred sodiščem. Zato se ponudnik prizadeva po svojih najboljših močeh, da se morebitni spori rešijo sporazumno.


Odgovornost ponudnika

Ponudnik se po svojih najboljših močeh trudi zagotoviti ažurnost in pravilnost podatkov, ki so objavljeni na njegovih straneh. V primeru netočnih podatkov glede lastnosti izdelkov, rokov dobave ali cen bo ponudnik kupca obvestil o spremembah in mu omogočil odstop od naročila ali zamenjavo naročenega izdelka. Ponudnik si pridržuje pravico objave simbolnih fotografij izdelkov.


Varovanje osebnih podatkov

Pravica do varstva osebnih podatkov je temeljna pravica in svoboščina posameznika. Področje ureja Splošna uredba o varstvu podatkov (GDPR) Evropske unije, ki postavlja skupna pravila za varstvo osebnih podatkov v EU. Nekatera vsebinska in postopkovna vprašanja pa lahko posebej uredijo države članice EU. Ta področja pri nas ureja Zakon o varstvu osebnih podatkov (ZVOP-2). ZVOP-2 velja od 26. 1. 2023.

Ponudnik se zavezuje k trajnemu varovanju vseh osebnih podatkov uporabnika. Le-ti bodo uporabljeni izključno za potrebe izpolnitve naročila (pošiljanje informativnega gradiva, ponudb, računov) in ostalo potrebno komunikacijo. Uporabnikovi podatki v nobenem primeru ne bodo predani nepooblaščenim osebam. Za varovanje osebnih podatkov je odgovoren tudi uporabnik sam in sicer tako, da poskrbi za varnost svojega uporabniškega imena in gesla.

The General Terms and Conditions of the online store are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), and the Electronic Communications Act (ZEKom-1).

The online store is operated by An-Ja kozmetične storitve Anja Lugariček s.p., Podgorje 7, 3000 Celje, VAT ID: SI24073563, which is also the seller.

The General Terms and Conditions define the operation of the online store, the rights and obligations of the user and the store, and regulate the business relationship between the seller and the buyer.

The buyer is bound by the General Terms and Conditions valid at the time of purchase (placing an online order). When placing an order, the buyer is always reminded of the General Terms and Conditions, and by placing the order, the buyer confirms their awareness and acceptance of these terms.


DEFINITION OF TERMS

  • Provider – An-Ja kozmetične storitve Anja Lugariček s.p., Podgorje 7, 3000 Celje, VAT ID: SI24073563.

  • User – A person using our system, i.e., the buyer in the online store.

  • Online Store – An information system intended for presenting and selling products to the user.

The General Terms and Conditions govern the operation of the online store Lepika.si (cosmetic online store), user rights, and the business relationship between the provider and the buyer.

The provider undertakes to always provide the buyer with the following information:

  • Company identity (company name and registered address, registration number).

  • Contact addresses enabling fast and effective communication (email, phone).

  • Essential product or service features (including after-sales services and warranties).

  • Product availability (each item or service on the website should be available within a reasonable timeframe).

  • Conditions for product delivery or service performance (method, place, and delivery time).

  • All prices must be clearly and unambiguously stated, indicating whether they include taxes and shipping costs.

  • Payment and delivery methods.

  • Offer validity period.

  • The period within which withdrawal from the contract is still possible, along with information about the cost of returning the product (if any).

  • Complaint procedures, including all contact information for the customer service department.


PURCHASE PROCESS

After viewing products on the website, the user adds the desired product to the cart, selecting color, size, and quantity if applicable.
In the following steps, the user must select the delivery location and payment method.
When the user selects products and clicks "COMPLETE PURCHASE", the online store automatically generates and sends an email containing the order details (products, prices, quantities, user information, etc.).
This confirms the order, and the products will be shipped as soon as possible.
If the delivery time exceeds 2 business days, the provider will notify the buyer.


DISCOUNTED PRICE OF A PRODUCT

Certain products that have been on sale for a longer period may be offered at discounted prices during specific promotional periods. Promotional prices are valid only for the specified period.


RETURN OF GOODS AND RIGHT TO WITHDRAW FROM THE CONTRACT (FOR INDIVIDUAL CONSUMERS)

The buyer (this applies exclusively to individuals purchasing goods for purposes unrelated to their business activities) has the right, under the Consumer Protection Act, to notify the company within 14 days of receiving the goods by email (info@lepika.si) or phone (070 873 227) that they are withdrawing from the contract, without having to provide a reason.
The 14-day withdrawal period starts on the day after the goods have been received.

The only cost borne by the buyer in connection with withdrawal from the contract is the cost of returning the goods, except in cases where the seller has also provided free training for using the goods. In such cases, upon withdrawal, the buyer will be charged for the training costs, at the rate specified in the offer and known to the buyer in advance.

The goods must be returned to the provider no later than 14 days after the withdrawal notification. Returning the goods within this period is considered a withdrawal from the contract.

The returned product must be unused, undamaged, in the original packaging, and in unchanged quantity.
If the goods are damaged, dirty, without original packaging, or show signs of use (inside or outside the item), the seller reserves the right to reduce the refund amount.

The buyer does not have the right to withdraw from contracts for goods made according to the buyer's specific instructions, adapted to personal needs, goods not suitable for return due to their nature, perishable goods, or goods past their expiration date.

The buyer must return the item undamaged and in unchanged quantity unless it has been damaged, spoiled, or lost through no fault of the buyer.
The buyer may only inspect and test the goods to the extent necessary to determine their actual condition.
The buyer is responsible for any reduction in the value of the goods resulting from handling that is not necessary to determine the nature, characteristics, and functionality of the goods.


SPECIAL PROVISIONS

If the buyer receives free training on product use when purchasing goods and later withdraws from the contract within the legal period, the buyer must reimburse the cost of the free training provided by the seller.

For bulk purchases, the buyer is entitled to a quantity discount in accordance with the company’s internal price lists, based on the purchase amount.
If the buyer partially withdraws from the contract, the final quantity discount will be proportionally reduced.


PAYMENT

The provider issues an invoice on a durable medium, detailing all costs and instructions on how to withdraw from the purchase and return products.
The user pays for the ordered goods either via pro forma invoice (bank transfer) or by credit card.


DELIVERY TIME

For products in stock, delivery takes 2–4 business days. In other cases, up to 15 days.
For products not in stock, the delivery time is up to 15 days after receiving the order.
If the delivery time is longer, we will inform you via email or phone.
We will also inform you if a product is unavailable.


DELIVERY

The provider must deliver goods or services within the promised time.
Upon delivery, the user must receive additional information about their right to withdraw, including conditions and procedures for exercising this right.
The provider must also provide all necessary contact details for complaints, as well as information regarding warranties, servicing, or other post-purchase services.
Delivery costs depend on the order and are based on the weight of the purchased products.

The buyer must ensure an unobstructed path for bringing the ordered goods into the apartment and protect floors and other equipment in the apartment.
If access is blocked or the building structure prevents delivery (narrow stairs, spiral staircases), we cannot guarantee delivery.
The doorway must be at least 80 cm wide.

If you insist on delivery despite not meeting these conditions, material damage may occur to either the product or your property. We are not liable for any resulting damages.

Upon receipt of the appliance, the buyer must ensure proper protection.
If we collect it without protective packaging, we are not responsible for damage (scratches, dents, etc.) occurring during transport.


SHIPPING COSTS

Deliveries are made Monday through Friday as indicated with each product.

The buyer pays the shipping cost for ordered goods.

Shipping price list:

  • Up to 25 kg: €4.99

  • 26–40 kg: €24.99

  • Over 41 kg: €60.00

  • Additional fee for cash-on-delivery: €1.00

Claims upon receipt of shipment

If you receive the wrong number of products that do not match the quantity on the delivery documents, or if the goods were damaged during transport, please contact the delivery service that made the delivery. At the same time, inform us as well, so we can assist you in resolving the issue.

If, upon receipt, you notice that the item or package is physically damaged, part of the contents is missing, or the package shows signs of being opened, you may initiate a compensation claim with the courier.

If the package was delivered by GLS and you find that the item is damaged, content is missing, or the package has been opened, you must report the damage within 7 days of receiving the package by emailing info@lepika.si or calling +386 70 873 227. When reporting damage, we require photos of the package, packaging, damaged item, GLS label, and a description of the damage. By agreement with our representative, we can arrange for the collection of the damaged package from your address.


Withdrawal from the contract (for consumers)

In accordance with the Consumer Protection Act, private individuals have the right to inform the seller within 14 days of receiving the product that they are withdrawing from the contract, without any obligation to provide a reason. In this case, the consumer must return the goods at their own expense to our address no later than 14 days from notifying us of the withdrawal. The period begins on the day after the package is received. The only cost to the consumer is the return shipping cost (as per the courier's price list).

Please enclose a copy of the invoice and a correctly completed return form to ensure faster processing.

Important:

  • Product inspection and testing are only allowed to the extent necessary to determine its actual condition. Any use of the goods beyond this scope will be considered as use, and you will be liable for a decrease in the product's value.

  • If you find that the item is unsuitable (color, size, etc.), do not fully open it. Labels and tags must remain intact.

  • Keep the packaging and accessories for at least six months after receipt.

  • The product must be returned undamaged and in the same quantity, unless it was destroyed or damaged through no fault of your own.

  • We do not accept cash-on-delivery (COD) shipments.

Refund rights, warranty claims, material defects, and complaints are governed by the Consumer Protection Act (ZVPot).


Instructions for contract withdrawal

When purchasing online, you cannot physically inspect the products, so we allow you to withdraw from the contract within the statutory period. For a smooth process, please follow these guidelines:

  • Open packaging carefully and keep it intact until you are sure about the product’s suitability.

  • Handle items with care, as damages can easily occur, especially on lacquered surfaces (monitors, LCD TVs, etc.).

  • Remove protective films carefully.

  • Before installing appliances, ensure they are suitable.

  • The right to withdraw from the contract is not intended for warranty claims or product defect complaints, but rather when a product does not meet your expectations.


Returning items

Guidelines:

  • We recommend using a tracked delivery service.

  • Return shipping costs are borne by the sender, unless otherwise agreed. We do not accept COD shipments.

  • If you are making a warranty claim, the repaired item will be returned to you by mail.


Returns for legal entities

Legal entities (companies, sole proprietors, etc.) do not have the right to withdraw from the contract within 14 days as consumers do. Returns are only possible under warranty conditions. For more information, contact us at +386 70 873 227 or info@lepika.si.


Returning items via our collection service

If we arrange collection with our delivery service, we are not responsible for any potential damage to the packages.

Return guidelines:

  • Enclose the contract withdrawal form.

  • Send items to the following address: Podgorje 7, 3000 Celje, Slovenia.

  • Prepare products for safe transport (preferably in the original packaging).

  • We do not accept COD shipments.

  • If you used a discount code when purchasing, its value is non-refundable. We only refund the actual paid amount.

  • Refunds will be processed within 14 days of receiving the withdrawal notice. Refunds will be made in the same way as the payment, unless agreed otherwise.

  • Products that are sealed and cannot be returned for hygiene reasons cannot be returned once the seal has been broken.

  • In exceptional cases where products are not returned in accordance with ZVPot, we may offer a buy-back with compensation by agreement.


Complaints

If the package is missing documents, warranties, cables, instructions in Slovenian, or if the invoice is incorrect, please contact us. Missing documents and explanations will be delivered as soon as possible.

If you wish to exchange a product due to a defect, return it unused, undamaged, and in its original packaging. Enclose a copy of the invoice and the return form with the return.


WARRANTY

In accordance with the law, the manufacturer is obliged to provide the customer with a warranty for the proper functioning of the purchased goods. The warranty can be claimed directly with the manufacturer or their authorized service center. The buyer must present the warranty card and the seller's invoice. The manufacturer is required to carry out warranty repairs within 45 days of receiving the goods, otherwise the item must be replaced with an equivalent, faultless product.

The buyer can also claim the warranty with the seller; in this case, the same conditions apply. The warranty claim process is carried out in accordance with the conditions specified on the warranty card, with no cost to the buyer.

Claims for non-conformity

Warranty claims and other consumer rights in case of non-conformity. In the event of non-conforming goods, the consumer who has informed the seller of the non-conformity is entitled, under the conditions and in the order set by law, to:

  • request the seller to restore conformity of the goods free of charge;

  • request a reduction of the purchase price in proportion to the non-conformity, or withdraw from the sales contract and request a refund of the amount paid.

The consumer may withhold payment of the remaining purchase price, or part thereof, until the seller has fulfilled their obligation. The consumer enforces this right by submitting a statement informing the seller of their decision.

In all cases, the consumer also has the right to claim compensation, particularly for costs of materials, spare parts, labor, transportation, and shipping incurred due to a warranty claim.


Restoring conformity

The consumer can request the seller to restore the conformity of the goods free of charge within a reasonable time from when the seller was informed of the non-conformity, which may not exceed 30 days, without significant inconvenience to the consumer, taking into account the nature of the goods and their intended purpose.


Reduction of price and contract withdrawal

The consumer may request a proportional reduction in the purchase price or withdraw from the contract in any of the following cases:

  • the seller has not repaired or replaced the goods, or, where appropriate, has not completed the repair or replacement in accordance with the law, or has refused the consumer's claim to restore conformity;

  • the non-conformity persists despite the seller's attempt to restore conformity;

  • the nature of the non-conformity is so serious that it justifies an immediate proportional reduction of the purchase price or withdrawal from the contract; or

  • the seller has stated, or it is evident from the circumstances, that they will not restore conformity within a reasonable time or without significant inconvenience to the consumer.

Regardless of the above, the consumer may withdraw from the sales contract and request a refund if the non-conformity occurs within 30 days of delivery.

If the consumer requests a proportional reduction of the purchase price, the reduction will correspond to the decrease in the value of the goods received compared to the value the goods would have had if they were conforming.

The consumer enforces the contract withdrawal by submitting a statement informing the seller of their decision.


Security

The provider uses appropriate technological and organizational measures to protect the transfer and storage of personal data, orders, and payments.

Communication

The provider may contact the user via remote communication means only if the user does not expressly object.

The provider will confirm receipt of the complaint within five working days, inform the customer about the processing timeline, and keep them updated on the progress.

The provider acknowledges that the main obstacle for consumers in pursuing legal disputes is the disproportion between the economic value of the claim and the costs of legal proceedings. Therefore, the provider will make every effort to resolve potential disputes amicably.


Provider's Responsibility

The provider strives to ensure the accuracy and timeliness of the data published on its website.
In case of incorrect information regarding product features, delivery times, or prices, the provider will inform the customer of the changes and allow them to cancel the order or replace the ordered product.
